All proceedings under the Code are confidential. All proceedings and all documents generated by the process form a part of the accused student's records and are therefore confidential under the Federal Family Educational Rights and Privacy Act (FERPA). Participants in the process, including the accused student, the complainant, witnesses, hearing board members, and staff members are advised to preserve the confidentiality of all proceedings and all documents under this Code. Any breach of confidentiality may subject the responsible party to charges under this Code.

A joint hearing board is comprised of 2 faculty, 2 students, and one staff member. However, a hearing may occur with a minimum of one faculty, student, and staff. The chief judicial officer, or designee, presides as a non-voting member of the board to maintain process. Accused students have the right to challenge any of the board members whom the student believes cannot objectively render a fair decision in the case.

While the details of a judicial hearing are explicated within the Code of Student Conduct, students will have the opportunity to present their evidence, to bring witnesses, and to question the witnesses of the complainant. Accused students may have an advisor help them prepare testimony and accompany them to the hearing. The advisor is not an active participant in the hearing and must be a Tulane University faculty, staff, or student.

The joint hearing board will render a decision of responsible or not responsible based on all the evidence presented. If the student is found not responsible, the hearing is adjourned and all charges dropped. If the student is found responsible, the joint hearing board will deliberate and appropriate sanction. The accused student has the right to the appeal the decision of the joint hearing board (see appeals section).
